This revisional application is directed against an order dated November 17, 2025 passed by the learned Civil Judge (Senior Division), 2nd Court at Barasat in Title Suit No. 371 of 2024 whereby the suit has been taken off the ex parte board and the written statement filed by the opposite party has been accepted. 2. Mr. Banerjee, learned Advocate appearing for the petitioner fairly submits that although the order impugned does not assign any reason for accepting the written statement however, it will be evident from the application filed by the opposite party seeking removal of the suit from the ex parte board and for acceptance of the written statement that cogent reasons have been given. 3. It is noted that the application filed by the opposite party avers that no copy of plaint, injunction application or documents relied upon were served upon the opposite party. It is also 2 noted that such fact has not been denied by the petitioner. Mr. Banerjee, learned Advocate appearing for the petitioner fairly accept such position and submits that hearing of the suit may be expedited. 4. In such view of the matter the order impugned is not interfered with. However, since the suit is one for eviction of a licensee therefore the learned Civil Judge (Senior Division), 2nd Court at Barasat is requested to dispose of Title Suit No. 371 of 2024 as expeditiously as possible and preferably within a period of one year from the next date fixed without any unnecessary adjournment to either of the parties. 5. C.O. 4218 of 2025 stands disposed of. No costs. 7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
