P.P. …...... 02/24.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 96, 143 and 3(5) of the Bharatiya Nyaya Sanhita. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. Chargesheet has been submitted under Sections 96 and 3(5) of the Bharatiya Nyaya Sanhita. 5. The allegation against this petitioner is that he had kidnapped the daughter of the informant. 6. The trial is in progress, wherein the daughter, who is P.W.-2, has clearly denied the prosecution case, thus, has been declared hostile, so is the status of the informant, who is P.W.-1. 7. Considering the fact that the informant and the victim have denied the prosecution case, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Sahibganj in connection with Mirzachowki Police Station Case No.77 of 2024 (S.T. No.185 of 2025) subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his own name within the State of Jharkhand.
