Mr. Kollol Maity Mr. Rajib Kumar Acharyya …for the petitioner Mr. Biplab Guha Mr. Bikramjit Mandal … for the State The respondent no.9 has preferred the appeal under Section 10(4) of the West Bengal Highways Act, 1964 challenging the order of the Assistant Engineer, Tamluk Highway Sub-Division, Public Works (Roads) Directorate, Tamluk, Purba Medinipur dated 28th February, 2025. This writ petition has been filed by the writ petitioner praying for speedy disposal of the appeal filed by the respondent no.9. The learned Advocate appearing for the petitioner submits that the said appeal was filed on July 23, 2025, but no date of hearing of such appeal has been fixed by the appellate authority. The learned Advocate appearing for the State submits that the said appeal shall be disposed of within the time limit as may be fixed by this Court. In the light of the submissions made by the learned Advocates for the respective parties, WPA 27287 of 2025 stands disposed of by directing the District Magistrate, Purba Medinipur, being the Appellate Authority under Section 10(4) of the West Bengal Highways Act, 1964 to take up the hearing of the appeal petition filed by the respondent no.9 dated July 23, 2025 and to dispose of the same by passing a reasoned order which shall be communicated to the petitioner and the private respondents as expeditiously as possible but positively within a period of six weeks from the date of receipt of a server copy of this order. The leaned Advocate-on-Record of the petitioner shall be obliged to forward a server copy of this order along with a copy of the writ petition to the respondent no.9 forthwith. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Hiranmay Bhattacharyya, J.) 2
