JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.56006/2023 pending before the XXIX Addl. Chief Metropolitan Magistrate, at Mayohall, Bengaluru City, for the offences under Sections 498A, 504, 506 read with 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Pradeep H.S., learned counsel appearing for the petitioner, Smt.Rashmi Patel, learned HCGP appearing for respondent No.1, Sri.K.K.Vasanth, learned counsel - 3 - HC-KAR NC: 2026:KHC:30587 WP No. 27556 of 2023 appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo in that regard. The said Joint Memo reads as follows: "1. The petitioner is the relative of the Respondent No.2. The petitioner is the Accused No.4 in C.C. No. 56006/2023 have filed this petition before this Hon'ble Court for quashing the charge sheet and entire proceedings in C.C. No. 56006/2023 registered by Respondents No.1/ Marathahalli Police station for the commission of the alleged offences punishable under Sections 498A, 504, 506 r/w 34 of I.P.C and section 3 and 4 of the D.P. Act on the file of the XXIX ADDL. METROPOLITAN MAGISTRATE, AT MAYOHALL, BENGALURU CITY, wherein this Hon'ble Court has passed the interim order by staying further proceedings in C.C.No.56006/2023 against the petitioner. 2. That during the pendency of this petition due to the intervention of the family members and well-wishers of the petitioner along with other Accused persons and the respondent No.2 have sought out their difference and resolved their dispute. Accordingly, the Accused No.1 who is the husband of the Respondent No.2 and the respondent No.2 agreed to live separately by dissolving their marriage. 3. The Accused No.1 is agreed to pay a sum of Rs.11,00,000/- (Rupees Eleven Lakh only) to the respondent No.2 towards her permanent alimony. On the other hand, the respondent No.2 has also agreed for the same and also agreed to cooperate to the petitioner to close or quash the charge sheet and proceedings in - 4 - HC-KAR NC: 2026:KHC:30587 WP No. 27556 of 2023 C.C. No. 56006/2023 which is filed against the petitioner in the present petition before this Hon'ble Court. 4. The Accused No.1 and the respondent No.2 in view of the aforementioned terms have filed the petition before the Hon'ble II Addl. Judge Family Court at Bengaluru under Section 13 (B) of Hindu Marriage Act for divorce by mutual consent on 22.11.2025 and also filed the application for dispensation of cooling period. The said application is allowed and the matter was referred to mediation. 5. The Accused No.1 is paid sum of Rs. 6,00,000/- to the Respondent No.2 by way of D.D. bearing No. 744332 dated 12.01.2026 drawn on IDFC FIRST BANK, AECS Layout, Bengaluru on 12.02.2026 before family court and agreed to pay the balance Rs. 5,00,000/- before this court at the time of disposal of the petitions and both parties also signed the mediation settlement agreement. On the basis of the said mediation settlement agreement the Hon'ble Family Court dissolved the marriage between Accused No.1 and Respondent No.2 and granted the decree of divorce by its order dated on 12.02.2026. 6. The petitioner and the respondent No.2 jointly and voluntarily filing this Joint memo to quash the charge sheet and entire proceedings in C.C. No. 56006/2023 registered by Respondents No.1/ Marathahalli Police station for the commission of the alleged offences punishable under sections 498A, 504, 506 r/w 34 of I.P.C and section 3 and 4 of the D.P. Act on the file of the XXIX ADDL. METROPOLITAN MAGISTRATE, AT MAYOHALL, BENGALURU CITY against the petitioner. Wherefore, the petitioner and the respondent No.2 humbly prays that this Hon'ble Court to quash the charge sheet and entire proceedings in C.C. No. 56006/2023 registered by Respondents No.1 / Marathahalli Police station for the commission of the alleged offences punishable under sections 498A, 504, 506 r/w 34 of I.P.C and section 3 and 4 of the D.P. Act on the file of the XXIX ADDL. The parties to the lis are present before the Court and are identified by their respective counsels. 5. Learned counsel appearing for the petitioner submits that demand draft of Rs.5,00,000/- is paid to the counsel for the respondent No.2, the same is acknowledged by the respondent No.2 who is present before the Court. 6. In the light of Joint Memo as quoted supra being filed by the parties to the lis and offences not being against the State, I deem it appropriate to accept the Joint Memo and terminate the proceedings against the petitioner in the subject petition. 7. For the aforesaid reasons, the following: ORDER [I] Writ Petition is disposed. [II] Proceedings in C.C.No.56006/2023 pending before the XXIX Addl.
