The petitioner is apprehending his arrest in connection with Piparwar P.S. Case No.20 of 2026, for offence registered under section 303(2), 317(5), 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate First Class, Chatra.

Learned counsel for petitioner submits that the petitioner happened to be owner of the truck in question and the allegations are made of carrying 31 pieces of Water Treatment pipes on the said vehicle. He next submits that the petitioner is having no criminal antecedent as disclosed in paragraph no.11 of the petition and the vehicle in question is a commercial vehicle and the said vehicle has already been seized and, on these grounds, he submits that anticipatory bail may kindly be granted.
4. Learned State counsel opposes prayer and submits that

illegally 31 pieces of Water Treatment pipes were being carried on the said Eicher truck.

Considering that that the petitioner is owner of the said truck and it has been pointed out that the said vehicle is a commercial vehicle and the petitioner is having no criminal antecedent as disclosed aforesaid, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Chatra, in connection with Piparwar P.S. Case No.20 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
