The petitioners are apprehending their arrest in connection with Balumath P.S. Case No. 132 of 2025, registered for the offence under Sections 303(2) and 317(5) of Bharatiya Nyaya Sanhita, 2023, Section 21 of the Mines and Minerals (Development and Regulation) Act, 1957, Rule 13 of the Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rules, 2017, pending in the court of learned Chief Judicial Magistrate, Latehar. 3. Learned counsel appearing for the petitioners submits that both the petitioners are the owner-cum-driver of two trucks and it has been alleged that the said trucks were parked along with illegal coal near the weigh bridge. He next submits that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-6 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that illegal coal was loaded on both the trucks. 5. Considering that both the vehicles were parked near the weigh bridge and both the petitioners are said to be the owner-cum- driver of the respective trucks and petitioners are having no criminal [ 2026:JHHC:3357] -2- antecedent and disclosure to that effect has been made in para-6 of the petition, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the petitioners, named above, are directed to surrender before the learned court within four weeks from today and in the event of their surrender / arrest, the petitioners, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Balumath P.S. Case No. 132 of 2025, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated:-09.02.2026 Amitesh/-
