However, on perusal of the case record and as pointed out by the learned counsel for the petitioner, the informant/ complainant has not been made a party in this case, who is a necessary party, as the case relates to N.I. Act case. In view of this, the learned counsel for the petitioner has submitted that due to this technical error, he may be allowed to withdraw the present petition, with a liberty to file afresh.
