Heard the parties.
The petitioners have been made accused in connection with Balidih P.S. Case No. 121 of 2025 (G.R. case no. 624 of 2026) instituted under Section 305(a), 331 (4) of BNS, 2023.
Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners committed theft from the house of the informant after breaking the main door and took away gold and silver ornaments from the boxes kept in the almirah after breaking them. It is submitted that the allegation against the petitioners is false and the petitioners are not named in the FIR. It is further submitted by learned counsel for the petitioners that the petitioners have been implicated in this case only on the basis of confessional statement in Chira Chas P.S. case no. 151 of 2025. It is next submitted that the petitioners have been in jail custody since 01.04.2026, as mentioned in para 1 of this bail application. It is next submitted by learned counsel for the petitioners
that the petitioners are ready and willing to co-operate with the trial of the case and undertake not to annoy or disturb the informant or the other witness of the case in any manner during trial of the case, hence, the petitioners may be admitted to bail. Learned Addl. P.P. opposed the prayer for bail. Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioners on bail. Hence, the court below is directed to release the petitioners on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- 1, Bokaro in connection with Balidih P.S. Case No. 121 of 2025 (G.R. case no. 624 of 2026) with the condition that the petitioners will not annoy or disturb the informant or the other witness of the case in any manner during trial of the case and will co-operate with the trial of the case and will furnish mobile phone number and photocopy of the Aadhar Card in the court below with an undertaking that they will not change the mobile phone number during the trial of the case.
