The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to quash/set-aside the impugned transfer order dated 12.06.2025 (Annexure P/1) so far as it concerns the present petitioner. 10.2 That, this Hon’ble Court may kindly be pleased to decide the representation of the petitioner for dated 19.06.2025. 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to post the petitioner on the place as desired by the petitioner on his earlier place of posting keeping in view of the Transfer Policy, 2025 and the medical condition of the petitioner. 10.4 Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice.” 2. Learned counsel for the petitioner submits that under the Rationalization Scheme of the State Government, petitioner has been transferred from Government Higher Secondary School, Keshavpur, Ambikapur, District – Sarguja to Government Higher Secondary School, Block – Magarlod, District – Dhamtari. He contended that the petitioner is a patient suffering from kidney problems and also underwent kidney transplant in 2008 and is taking continuous treatment. Petitioner has also submitted a representation against his transfer, however, it was rejected arbitrarily by the Divisional Level Committee vide order dated 25.09.2025. 3. On the other hand, learned counsel for the Respondents/State opposes the submission of learned counsel for the petitioner and would submit that the medical document which is enclosed along with the writ petition is of the year 2008–09 and no recent document has been enclosed. She however submits that the petitioner has even not raised a ground that any other similarly situated Lecturer is posted in nearby place under the Rationalization Scheme. 3 4. At this stage, learned counsel for the petitioner submits that as the petitioner has already joined at his transfer place of posting i.e. Government Higher Secondary School, Magarlod, Block – Magarlod, District – Dhamtari, he may be permitted to withdraw this writ petition with liberty to file a fresh representation before the concerned authorities seeking an on request transfer to a nearby place where the wife of the petitioner is also posted as Teacher, along with all the supporting documents and a direction be issued to the concerned authority to consider the representation to be submitted by the petitioner at the earliest. 5. I have heard learned counsel for the parties and also perused the documents placed on record. 6. On due consideration of the submission of counsel for the parties, nature of grievance raised by the petitioner, I find it appropriate to dispose of this writ petition permitting the petitioner to submit a fresh representation raising all the grounds as raised in this writ petition and if such a representation is submitted by the petitioner, concerned authority shall consider and take decision on the representation in accordance with law, expeditiously taking into consideration the grounds and documents to be enclosed along with the representation. 7.
