Singh, Advocate Ms. Arpita Sinha, Advocate For the Respondent(s) : Mr. Ashutosh Anand, AAG-III Mrs. Sweety Topno, Advocate Mr. Amrit Raj Kisku, Advocate ------ 13/ 20.08.2026 By filing this writ petition, the petitioner has prayed for the following reliefs :- "a) For issuance of an appropriate writ especially in the nature of certiorari for quashing the order dated 09.07.2019 as contained in Annexure-6 passed by the court of Additional Collector, Dhanbad cum- Arbitrator under the NHAI Act (respondent no.2) in arbitration case no.49/2018 preferred by the petitioner under section 3(G)(5) of the National Highways Act 1956 pertaining to plot no. 427, 428, 429, 431, 432, Khata no.4, 20, 28, 17, 17 respectively situated at Mauza Chalkari, P.S. Topchanchi, Dist. Dhanbad which has been acquired by the NHAI for up gradation of the existing road to six lane under the L.A. Case No.40/2014-15. b) For an appropriate order commanding upon the respondent no.2 to adjudicate the dispute raised by the petitioner under section 3G(5) of the National Highways Act i.e. within the four corners of the Arbitration and Conciliation Act 1996 being the sole arbitrator." 2026:JHHC:25427 2 2. Heard learned counsel representing the petitioner and learned counsel representing the respondents. 3. The petitioner claims compensation after valuation of certain structures standing on his plot, such as boundary wall, weigh bridge, concrete platform etc. 4. With regard to the aforesaid claim, the petitioner moved an application before the Additional Collector, Dhanbad-cum- Arbitrator, under the National Highways Act. 5. After going through the impugned order dated 09.07.2019 passed by the Additional Collector, Dhanbad-cum- Arbitrator, which is simply one-page order, this Court finds that the same cannot be said to be an Award, as the same lacks adjudication of dispute in its proper perspective. 6. Thus, the impugned order dated 09.07.2019 in Arbitration Case No.49/2018, passed by the Additional Collector, Dhanbad-cum-Arbitrator (Annexure-6 to the writ petition), is hereby set aside. 6.1. The respondents are directed to adjudicate the claim of the petitioner afresh, if necessary, by leading evidence. 7. Accordingly, this Writ Petition stands allowed.
