By way of this Writ Petition, the petitioner is seeking following reliefs:- 10.1 That, this Hon'ble Court may kindly be pleased to Issue an appropriate writ, order or direction, preferably in the nature of mandamus, restraining the respondents from dispossessing the petitioner and her family from the house situated at Village Sendh, Tahsil Mandir Hasoud, District Raipur, without following due process of law. 10.2 That, this Hon'ble Court may kindly be pleased to issue AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.07.01 10:25:38 +0530
2 an appropriate writ, order or direction directing the respondents to not carry out any demolition or construction activity over the land in possession of the petitioner. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to issue an appropriate writ, order or direction directing the respondents to grant rehabilitation/resettlement and compensation to the petitioner strictly in accordance with the applicable State policy before taking any coercive action. 10.4 Any other relief as this Hon'ble Court may deems fit looking to the facts and circumstances of the case may also be awarded. 2. Learned counsel for the petitioner submits that the petitioner is residing at the subject land granted to her by way of patta/lease and has constructed the house from the grant received by her under the Indra Awas Yojna/Gramin Awas Kutir in the year, 2015-16.
He submits that a list was released in respect of village Sendh, Tehsil Mandir Hasoud, District Raipur regarding grant of certificate for bhumiswami rights in rural areas in abadi land, in which, name of husband of petitioner finds its place at Serial No.2 for Khasra No.499/2, admeasuring 1,700 sq ft., patta No.1800374. However, respondent authorities are acting to dispossess the petitioner from her house, which is arbitrary and illegal. Learned counsel for the petitioner at this stage submits that this Writ Petition may be disposed of with a direction to the respondent authorities to decide the representation of the petitioner in this regard in an expeditious manner. 3. Learned counsel for respondents submits that if representation of the petitioner is pending it will be decided expeditiously. 4. Considering the limited prayer made by the petitioner as also the nature of
3 dispute, this Court deems it appropriate to dispose of this Writ Petition with a direction to respondent/competent authority to decide the representation of the petitioner, in accordance with law, after giving due opportunity of hearing to the petitioner. This be done within a period of 60 days from the date of receipt of copy of this order. 5. With the aforesaid direction, this Writ Petition is disposed of. Sd/-
