The petitioner is the wife of the detune Jayarama (CTP No.10789) is before this Court seeking for the following reliefs: a) Issue a Writ of Certiorari or other appropriate writ or order seeking to quash the Email Endorsement dated 21.06.2026 issued by the Respondent No.2 via Email ID: cpblr.prisons- kar@gov.in, rejecting the request for grant of emergency parole to the convict prisoner namely Jayaram, bearing CTP No.10789, vide ANNEXURE- C. b) Issue a Writ of Mandamus or other appropriate writ or order seeking a direction to the Respondent No.2 to release the convict prisoner namely Jayaram, bearing CTP No.10789, on an emergency - 3 - HC-KAR NC: 2026:KHC:32449 WP No. 19745 of 2026 parole for a period of 15 days, to enable him to attend and participate in the funeral ceremonies and perform the last rites and customary religious rituals of his deceased mother, namely Smt. Anjanamma, in terms of representation dated 24.06.2026, vide ANNEXURE-D. c) Pass any such other order/s as this Hon'ble Court deems fit under the facts and circumstances of the case, in the interest of justice & equity. 2. The detenu had been convicted in Spl.C.No.139/2017 for offences under Section 3762)(I), 372(2)(f), 376(2)(n) and 506 of IPC and Section 6 of POCSO Act by the III Additional District and Sessions Court, Tumkur and sentenced on 5.11.2018 with the highest of the sentence being imprisonment for life. The detenu has served a period of 9 years 6 months 10 days of imprisonment as on 27.06.2026. The petitioner having made an application for parole, the same came to be rejected. 3. A perusal of the police report indicates that it deals with the conviction of the detenu and does not cover any issue as regards the petitioner is at flight risk. 4. Learned counsel for the petitioner submits that the mother of the detune has expired on 19.06.2026 and the presence of the detune is required for performance of the death ritual ceremony. 5. In that view of the matter, this Court passes the following: - 4 - HC-KAR NC: 2026:KHC:32449 WP No. 19745 of 2026 ORDER i) The Writ Petition is allowed. ii) Respondent–Chief Superintendent, Central Prison, Bangalore, is directed to release the detenu- Jayarama (CTP No.10789) on emergency parole for a period of 15 days commencing from 01.07.2026, subject to the following conditions: a) The detenu shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the detenu would evade going back to the gaol, after the expiry of the period of parole. b) Respondent No.1- State of Karnataka shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. - 5 - HC-KAR NC: 2026:KHC:32449 WP No. 19745 of 2026 iii) The Registry is directed to communicate the order to the prison authority for its immediate execution. iv) The petitioner and family members of the detenu are directed to comply with all other formalities before the date fixed for release. v) Respondents are directed to act on the uploaded copy of the order without insisting for a certified copy.
