Learned counsel for the petitioner has submitted that during the pendency of the present petition, the charge-sheet against the accused has been filed before the learned Trial Court.

A perusal of the impugned order reveals that the petitioner had moved the bail application at a stage when the investigation was at its infancy and even the statement of the prosecutrix had not been recorded during the course of investigation. Now the charge-sheet stands already filed before the learned trial court, after conclusion of the investigation. The situation has changed, therefore, it would be appropriate for the petitioner to approach the learned trial court by way of fresh bail application in light of the changed circumstances.

In view of the above, learned counsel for the petitioner seeks permission to withdraw the present petition with leave and liberty to approach the learned trial court with an application for grant of bail.

Accordingly, the present petition is disposed of as having been withdrawn with leave and liberty to the petitioner to approach the learned trial court by way of fresh bail application in light of the changed circumstances. In the event, such an application is filed by the petitioner before the learned trial court, the same shall be dealt with by the said court in accordance with law, most expeditiously preferably within one month from the date of its filing.
