Mr. Vivek Thakur, Advocate vice Ms. Yuyutsu Singh Thakur, Advocate, for respondents No. 1, 2(ii) and 3. OMP No. 1022 of 2026 By way of present application, indulgence of this Court has been sought to place on record the copy of award No. 144 of 2014, dated 22.6.2018, passed by the learned Arbitrator. The application is considered and allowed and the documents, as prayed for, are ordered to be taken on record. The application is, thus, disposed of. OMP No. 930 of 2026 The appeal, preferred by the appellant/applicant will take sufficient long time, for its disposal. As such, during pendency of the appeal, execution of judgment, dated 18.10.2023, passed by the Court of learned District Judge, Bilaspur, District Bilaspur, H.P. in Arbitration Case No. 159 of 2018, titled as, ‘National Highways Authority of India versus Baniya Ram & ors.’ whereby, the impugned award dated 22.6.2018, passed by the learned Divisional Commissioner, Mandi, exercising the power of Arbitrator, under National Highways Act, 1956, has been upheld, is ordered to be stayed, subject to deposit of the entire awarded amount, alongwith up- to-date interest, within a period of eight weeks from today.
