02/ 27.08.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Mirzachouki P.S. Case No. 14 of 2026, registered under sections 318(4), 336(3), 338, 340(2), 3(5) of BNS, 2023, pending in the Court of learned S.D.J.M, Sahibganj.

Learned counsel for the petitioner submits that the petitioner is a journalist working in Indian Punch and to buttress this argument he refers to supplementary affidavit. He next submits that identity card has been brought on record as annexure-3 to the supplementary affidavit. He also submits that petitioner has cooperated with the police and replied to the notice under section 35(3) of BNSS, 2023. He next submits that the petitioner being the journalist has raised many questionable action of the administration due to which the Circle Officer has falsely implicated the petitioner. He next submits that petitioner has got no criminal antecedent which is disclosed in para 16 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of issuing false certificate of family list.

The identity card is annexed as Annexure-3 to the

supplementary affidavit. It appears that petitioner is a journalist working in Indian Punch which is published in Sahibganj and Godda districts. In para 39 of the case dairy it has come that petitioner has replied to the notice under section 35(3) of BNSS, 2023. The petitioner has got no criminal antecedent which is disclosed in para 16 of the petition,

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M, Sahibganj, in connection with Mirzachouki P.S. Case No. 14 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
