1. This is the first bail application filed under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 applicants who have been arrested in connection with Crime No.05/2025 registered at Police Station EOW/ACB, District Raipur (C.G.) for the offence punishable under Sections 409, 467, 468, 471 and 120-B of IPC and Sections 13(1)(a) read with Section 13(2) and 7(c) of the Prevention of Corruption Act, 1988.
2. The case of the prosecution, in brief, is that a secret information was received to the P.S. EOW/ACB, Raipur that in year-2021 under the Scheme "Hamar-Lab" (At District level & at level of Community health Centre) the Public Health and Family Welfare Department had directed the department to purchase necessary Equipment, Machines, etc. through C.G. Medical Services Corporation Ltd. (CGMSCL), acting on which CGMSCL had purchased the same in month of March-April,
2023. That the allegations are that "the Director of Health Services, CGMSCL and their officers without evaluating the budget and demand had placed the order of equipment, machines etc. disproportionately. And that is further alleged that the concerned officers in connives with the other companies while discharging their official duties, have improperly and dishonestly performed public duties and committed criminal misconduct by entering into a criminal conspiracy with Mokshit Corporation, CB Corporation, Records and Medicare System, Shri Sharda Industries and others companies, by purchase the same at much higher price than the actual with an intention to cause profit to the companies, and they have made unnecessary purchase of machines and reagents. That neither the availability of budget was not ensured for the said purchase nor was any administrative approval obtained in this regard. And in this whole exercise a total loss of
3 approx. Rs. 411 crores have been caused to the State Government. On the basis of the above, an FIR was registered at ACB/EOW, Raipur for the said offence against Officers of Chattisgarh Medical Services Corporation Limited Raipur and Officers of Operating Health Department; Mokshit Corporation, Ganj Para Durg; CB Corporation, GE Road, Durg; Records & Medicare System HSIIDC, Panchkula Haryana; Shri Sharda Industries, Village Tarra, Tehsil Dharsiva Raipur and others. Hence, this application.

Learned counsel for the applicants submits that the applicants have been falsely implicated in this case. It is argued that two other co- accused persons, namely Shashank Chopda and Kamal Kant Patanwar have already been granted bail by the Hon'ble Supreme Court vide order dated 17.04.2026 in SLP (Crl.) No. 3295/2026 and 5375/2026 and Basant Kumar Kaushik and Deepak Bandhe have already been granted bail by the Hon'ble Supreme Court vide order dated 05.05.2026 in SLP (Crl.) No. 4542/2026 and SLP (Crl). No. 5381/2026, respectively, another co-accused persons, namely, Shubham Barmecha has been granted anticipatory bail by this Court vide order dated 12.05.2026 passed in MCRCA No. 723/2026 and Dr. Anil Parsai, Rakesh Jain, Abhishek Kaushal and Kunjal Om Prakash Sharma have been granted regular bail by this Court vide order dated 12.05.2026, 14.05.2026, 14.05.2026 and 16.06.2026, respectively, further the applicants have no previous criminal antecedents, the charge-sheet has been filed in the present case, and the applicants are in jail since 18.01.2026 and 21.03.2025. As the conclusion of the trial is likely to take considerable time, the applicant seeks regular bail
4 on the ground of parity.

Learned counsel for the State/non-applicant opposes the bail application and submits that the charge-sheet has been filed in the present case but could not dispute the fact that identically situated other co-accused persons have already been granted bail by the Hon'ble Supreme Court and by this Court.
5. I have heard learned counsel for the parties and perused all of the documents available on record.

Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicants and the fact that two other co-accused persons, namely Shashank Chopda and Kamal Kant Patanwar have already been granted bail by the Hon'ble Supreme Court vide order dated 17.04.2026 in SLP (Crl.) No. 3295/2026 and 5375/2026 and Basant Kumar Kaushik and Deepak Bandhe have already been granted bail by the Hon'ble Supreme Court vide order dated 05.05.2026 in SLP (Crl.) No. 4542/2026 and SLP (Crl). No. 5381/2026, respectively, another co-accused persons, namely, Shubham Barmecha has been granted anticipatory bail by this Court vide order dated 12.05.2026 passed in MCRCA No. 723/2026 and Dr. Anil Parsai, Rakesh Jain, Abhishek Kaushal and Kunjal Om Prakash Sharma have been granted regular bail by this Court vide
order dated 12.05.2026, 14.05.2026, 14.05.2026 and 16.06.2026, respectively, further the applicant has no previous criminal antecedents, the charge-sheet has been filed in the present case, and the applicants are in jail since 18.01.2026 and 21.03.2025, as the conclusion of the trial is likely to take considerable time, this Court is of
5 the view that the applicants are entitled to be released on bail in this case on the ground of parity. 7. Accordingly, the present bail application is allowed. 8. Let applicants – Prince Kochar (Jain) and Kshirodra Routia, involved in Crime No.05/2025 registered at Police Station EOW/ACB, District Raipur (C.G.) for the offence punishable under Sections 409, 467, 468, 471 and 120-B of IPC and Sections 13(1)(a) read with Section 13(2) and 7(c) of the Prevention of Corruption Act, 1988, be released on bail on his furnishing a personal bond with two sureties in the like sum to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence, proclamation under Section 84 of BNSS. is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law, under Section 209 of the Bharatiya Nyaya Sanhita. 6 (iv) The applicant shall remain present, in person, before the trial court on the dates fixed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS.
If in the opinion of the trial court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against him in accordance with law. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
