Also heard Ms. Anusha Naik, learned Deputy Government Advocate for respondent/State. 2. Learned counsel for the petitioner has preferred this petition seeking modification of the conditions in the order dated 13.04.2026 passed in MCRC No. 3332/2026, granting bail to the petitioner. 3. The petitioner was granted bail by impugned order of this Court dated 13.04.2026 with the condition to execute personal bond with two local sureties, out of which one should be family member to the satisfaction of the concerned trial Court, as has RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 been mentioned in the para 9 of the said order. 4. Learned counsel for the petitioner submits that the the petitioner is a permanent resident of Village Vishala, Shiv Bhakri, District Barmer (Rajasthan) and all his family members are residing in the State of Rajasthan, and there is no family member of the petitioner residing locally within the State of Chhattisgarh, and therefore, he is unable to comply with the conditions stipulated by this Court in order dated 13.04.2026 while granting bail to him, and therefore, he could not be released on bail. Hence, praying for modification in the order dated 13.04.2026. 5. Learned State counsel has no objection. 6. Having heard the learned counsel of the parties, taking into consideration the facts and circumstances of the case, specially considering the fact that the petitioner is a permanent resident of Rajasthan, and due to non-availability of any local family member, he is unable to comply with the conditions stipulated by this Court in order dated 13.04.2026 while granting bail to him, we deem it appropriate to direct that the petitioner- Mukesh Gar be released on bail on furnishing only a personal bond with two sureties, out of which one shall be family member to the satisfaction of the trial Court concerned. 7. In view of the above, the condition mentioned as ‘two local sureties’ in para 9 of the order dated 13.04.2026 passed in MCRC No. 3332/2026, be modified and read as only ‘two sureties’. 3 8.
