In Crl.P.No.8642 of 2023 petitioner (accused No.13) seeks to quash the charge sheet in C.C.No.290 of 2018 filed for offences punishable under Sections 143, 147, 148, 186, 189, 353, 107, 341, 427, 506 r/w Section 149 of the IPC. In Crl.P.No.8653 of 2023 petitioner (accused No.10) is before this Court seeking to quash the charge sheet in C.C.No.303 of 2018 filed for offences punishable under Sections 143, 147, 148, 323, 354, 447, 188, 504, 506, 307, 427 r/w Section 149 of the IPC, both pending on the file of Principal Civil Judge and JMFC, Anekal, Bengaluru Rural District. 2. Heard Sri S Sunil Kumar, learned counsel appearing for the petitioner, Smt Rashmi Patel, learned High Court Government Pleader appearing for 1st respondent in both the cases and Sri M.S.Shyam Sundar, learned senior counsel - 5 - HC-KAR NC: 2026:KHC:31830 CRL.P No. 8642 of 2023 C/W CRL.P No. 8653 of 2023 appearing for 2nd respondent in Crl.P.No.8642 of 2023 and Sri Cyril Prasad Pais, learned counsel appearing for the 2nd respondent in Crl.P.No.8653 of 2023. 3. Facts in brief, germane, are as follows: The petitioner, at the relevant point in time, was working as the Registrar of Alliance University College. On 13-11-2017, two complaints come to be registered before the jurisdictional police, which becomes crime in Crime Nos. 190 of 2017 and 191 of 2017 respectively for the aforesaid offences against unknown persons. The contents of the complaint in Crl.P.No.8642 of 2023 was that the respondent no.2 who was on duty, receives an information from his staff CW11 and CW12 that some persons were hatching conspiracy with regard to the agitation to be conducted before the gate of the Alliance University College on 13-11-2017. Accordingly, when the 2nd respondent along with his staff went to the spot and tried to stop them, it is alleged that he was obstructed from carrying out his duties. The petitioner herein was drawn as accused at a later point in time while filing the charge sheet only on the score that he was the Registrar of the college at the relevant point in time and on the same incident, the other crime in Crime No.191 of 2017 has sprung, which has resulted in filing of the charge sheet in the said case as well and which is challenged in the companion petition. 4. The learned counsel appearing for the petitioner submits that the petitioner accused no. 13 has no role to play in the dispute between the parties. He was only a Registrar and has not committed any overt act, for him to be drawn into the web of proceedings. The learned counsel submits that apart from petitioner being the Registrar, he has no other claim or no other obligation in the Alliance University College nor would claim anything in future. 5. The learned senior counsel appearing for the respondent/complainant Sri M. S. Shyam Sundar in Crl.P.No.8642 of 2023 would submit that ingredients of the offences are made out, therefore the trial must be conducted - 7 - HC-KAR NC: 2026:KHC:31830 CRL.P No. 8642 of 2023 C/W CRL.P No. 8653 of 2023 for the petitioner to come out clean or would also leave the decision to the hands of the Court. 6. I have given my anxious consideration to the submissions made by the respective learned counsel and have perused the material on record. 7. The afore-narrated facts are not in dispute and they lie in a narrow compass. With regard to the role of the petitioner in Crl.P.No.8642 of 2023 is concerned, a suo motu complaint comes to be registered by the 2nd respondent on the score that several persons were agitating in front of the gate of Alliance University College. The petitioner is caught in the web of crime as accused no. 13. The police conduct investigation and file a charge sheet.
