The petitioner is apprehending his arrest in connection with Godda (Town) P.S. Case No.28 of 2026, registered for the offence under Sections 316(2), 319(2), 318(4), 316(5), 223 and 132 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Godda. 3. Learned counsel appearing for the petitioner submits that the petitioner was working as a House Father in the NGO which is registered in the name of Adim Jati Seva Kendra, Godda. He submits that Chair Person/Member of Child Welfare Committee gives the custody of child in an Institution/N.G.O. and the said N.G.O. is run by one Fatik Chandra Mahto. He submits that as the petitioner is working with the said N.G.O., and due to that only he has been implicated in the case. He next submits that the person, who is running the said N.G.O., has been granted anticipatory bail by this court in A.B.A. No.3635 of 2026. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of doing irregularities in running of the said N.G.O. 5. Considering that the person, who is running the said N.G.O., has been granted anticipatory bail in the aforesaid A.B.A. and the petitioner is said to be working in the said N.G.O. as a House Father and apart from that, there is no allegation of doing irregularities against the petitioner, in 2026:JHHC:24951 the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Godda, in connection with Godda (Town) P.S.
