The learned counsel appearing for the petitioner submits that the petitioner is challenging the appointment of respondent No. 4 as an Enquiry Officer for conducting an enquiry under Section 51 of the Andhra Pradesh Co-Operative Societies Act, 1964. 2. This Court, on 19.03.2014, granted time to the petitioner to examine G.O.Ms.No.34 dated 16.01.1989, in order to verify whether the 3rd respondent has power to initiate an enquiry under Section 51 of the said Act. 3. The learned Assistant Government Pleader appearing for the respondents submits that, as no interim order was passed by this Court, the enquiry under Section 51 of A.P.C.S. Act was completed and the report was also submitted by the Enquiry Officer, recommending recovery of the deficit share capital of Rs.2,470/- together with interest at 18% per annum from the delinquents. It is further submitted that the surcharge amount of Rs.35,531/- together with interest was recovered from the delinquents and that there are no pending recoveries from them. -4- HN, J W.P.No.8230_2014 4. Recording the same, this Court is of the considered view that nothing further survives to be adjudicated on merits. Accordingly, the present Writ Petition is closed. There shall be no order as to costs.
