This writ petition has been filed under Article 227 of the Constitution of India with the following prayers:- “(i) A writ, order or direction commanding the learned Court of Assistant Collector, First Class/ Sub-Divisional-Officer, Nainital to conclude and decide the proceedings of Election Petition No.25/02 of 2025, Manohar vs. Leela and Others expeditiously within a period as stipulated by this Hon’ble Court. (ii) Any other suitable writ, order or direction which this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case. (iii) Award the cost of petition to the petitioner.” 2. Heard Ms. Suraiya Naaz, learned counsel for the petitioner, Mr. Sanjay Bhatt, learned counsel for the respondent no.2 and Mr. K.S. Mehta, learned Additional 1 2026:UHC:1314 Chief Standing Counsel for the respondent no.3. 3. On 25.02.2026, Mr. Sanjay Bhatt, Advocate, sought 24 hours time to get instructions. 4. Today, Mr. Sanjay Bhatt, Advocate, submitted that instructions have been received, wherein three months’ time has been sought to decide the Election Petition No.25/02 of 2025. 5. Learned counsel appearing for the petitioner submitted on instruction that the petitioner shall not seek any unnecessary adjournment in the said election petition. 6. On the request of learned counsel for both the parties, the present writ petition is disposed of directing the Assistant Collector, Ist Class/ Sub-Divisional-Officer, Nainital to conclude the proceedings of Election Petition No.25/02 of 2025, “Manohar vs. Leela and Others”, expeditiously, but not later than three months from the date of production of the certified copy of this order. 7.
