GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents, particularly Respondent Nos. 3 to 5, in interfering with the peaceful possession and enjoyment of the petitioner over his house site admeasuring 613.33 square yards in R.S. No. 379-1 of Kallumadi Village, Singanamala Mandal, Anantapur District and preventing the petitioner from renovating or reconstructing his residential house and further compelling him to leave a portion of his land for formation of a road without following due process of law, as illegal, arbitrary, unconstitutional and without jurisdiction and consequently direct the respondents not to interfere with the petitioner's possession and enjoyment of the said property and permit the petitioner to renovate and reconstruct his house …” 2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3. Mr. V. R. Maheswara Rao Paleti, learned counsel for the Petitioner, submits that Respondent Nos. 3 to 5 are interfering with the Petitioner’s peaceful possession of his house site, obstructing renovation, and unlawfully compelling him to surrender land for a road without following due process of law. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that though the Petitioner claims ownership of the land, 3 field verification shows that the land is classified as Government waste land. The Petitioner has laid a basement there, encroaching upon a long‑standing public pathway, which has led to complaints from villagers. The Respondent Police advised him to vacate the Rasta portion to safeguard public convenience. 5. Having regard to the facts and circumstances of the case, and in view of the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent Police not to interfere henceforth in the civil dispute without following due process of law; however, if there is an allegation that the Petitioner has encroached upon public land or Government land, the Respondent Police are at liberty to proceed in accordance with law, based on instructions from the Revenue Department or the local authorities concerned. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
