Petitioner has filed this petition under Article 226 of the Constitution of India with following reliefs: “RELIEF(s) SOUGHT 10.1 It is therefore prayed that this Hon'ble Court may kindly be pleased to call for the entire records with regard to process of promotion of the petitioner from the post of head constable to assistant sub inspector. 10.2 That this Hon'ble Court may kindly be pleased to set aside/ quash the Order dated 08.06.2026 passed by respondent no.3 in Revenue Appeal e-court no. 202410072400273/A-6/2024-25 village- Sarkanda, p.h.no.-32, Bilaspur, Distt.- Bilaspur [C.G.]. 10.3 Any other relief which this Hon'ble Court may deem fit.” 3 2. Learned counsel appearing for the petitioners submits that the concerned Naib Tehsildar had allowed the application of the petitioners moved under Sections 109, 110 of the CG Land Revenue Code on the ground that they are the legal heirs of original land holder and objection of respondent no.2 was rejected on the ground that she has failed to prove that she is daughter of Rambhau. In an appeal before concerned Sub-Divisional Officer, on 20.05.2026 the SDO partially allowed the appeal and directed that name of the petitioners and respondent no.2 be mutated in revenue records. After passing the order, the SDO realized that mistake has been done by him, he sought review of order dated 20.05.2026 by way of an application dated 25.05.2026. The Additional Collector allowed the review application on 29.05.2026 and the SDO vide order dated 08.06.2026 behind the back of the parties reversed its own order and allowed the appeal while directing that name of respondent no.2 shall only be mutated in revenue records. Since, the order impugned was passed in grave violation of principle of natural justice, hence, petitioners have came-up before this Court with above prayer/reliefs. 3. Learned State Counsel submits that against the order dated 16.10.2024 passed by the concerned Naib Tahsildar, an appeal was filed before the concerned Sub-Divisional Officer (Revenue) and order has already been passed on 08.06.2026, as such, the petitioners have to file an appropriate appeal before the concerned 4 competent Authority. 4. Heard learned counsel for the parties and perused the pleadings of the writ petition including the order dated 08.06.2026. 5. Having regard to the facts of the case, nature of relief and submissions advanced by learned counsel for the parties, this Court is of the opinion that the petitioners have an efficacious alternative remedy to file an appeal under Section 44(2) of the Chhattisgarh Land Revenue Code, 1959. 6. Accordingly, without expressing any opinion on the merits of the case, the present writ petition is disposed of with liberty to the petitioners to avail the statutory remedy of appeal before the concerned Collector/Commissioner having jurisdiction. 7. In the event such an appeal is preferred before the competent Collector/Commissioner alongwith an application under Section 52 of the Chhattisgarh Land Revenue Code, 1959, the said authority shall consider and decide the same expeditiously by passing an appropriate order in accordance with law.
