ABLAPL No.7259 of 2026
Jagnyaseni Naik and others …. Petitioners
Mr. P.K Nayak, Advocate -Versus-
State of Odisha …. Opposite Party
Mr. S.K Lenka, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 01.07.2026
01.
1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection Bhanjanagar P.S. Case No.468 of 2026 corresponding to G.R Case No.821 of 2026 pending in the file of learned S.D.J.M, Bhanjanagar on the grounds stated therein.
3. Perused the FIR as at Annexure-1. It is submitted that the petitioners do not have antecedents. Mr. Lenka, learned ASC for the State informs this Court that the informant constructed a house after demarcation held with the immediate presence of R.I. and the local police, but thereafter, the accused persons committed the mischief, hence the FIR. It is claimed by the learned counsel for the petitioners that there is no grievous injury caused to the informant and other victims. This Court finds that the petitioners are the lady members of a common family. The alleged mischief has been committed by all the accused persons during the incident. As it appears the dispute is over construction made by the informant. Considering the p. 2 above facts and the submissions of the learned counsel for the respective parties and that the petitioners are ladies of a family though named in the FIR, this Court is inclined to direct them to surrender before the learned Court below for being released with suitable conditions even though not in favour of entertaining their bail plea as demanded.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioners surrender before the learned S.D.J.M, Bhanjanagar in connection with Bhanjanagar P.S. Case No.468 of 2026 corresponding to G.R Case No.821 of 2026 within a fortnight from today, they shall be released on bail on furnishing a bail bond of Rs.20,000/-(twenty thousand only) each for the like amount with one solvent surety with all other suitable conditions imposed with an additional condition that none of them shall pick up quarrel with the informant and latter’s family in any manner, while on bail.
6. Issue urgent certified copy as per rules.
