Learned advocate representing the petitioner submits that in view of ex-parte decree passed in Title Suit No.19 of 2019, petitioner has right over the land in question. It is also submitted that ex-parte decree dated 28th September, 2022 was put into execution by initiating an execution proceeding before the appropriate forum and such proceeding is pending. 3. However, it is alleged on behalf of the petitioner that private respondents are disturbing peaceful possession of the petitioner over the land in question as a result whereof present writ petition is filed seeking direction upon the concerned police authority to take steps for ensuring petitioner’s right over the land in question. 4. Learned advocate representing respondent nos.8 & 9 submits that those respondents have no interest in the land in question and they do not intend to possess the same. 5. On behalf of the State respondents a communication dated 17th June, 2026 of Inspector-in-Charge, Panskura Police Station, Purba Medinipur is filed and same is taken on [2] record. Copies of the said communication dated 17th June, 2026 are made over the learned advocates representing the petitioner and the respondent nos.8 & 9. 6. It is disclosed in the communication dated 17th June, 2026 that a criminal prosecution being Panskura P.S. Case No.453 of 2026 dated 17th June, 2026 is started under certain provisions of BNS, 2023. 7. Concerned police authority is directed to complete the investigation in connection with the aforesaid criminal prosecution at an early date and submit report before the jurisdictional Magistrate. 8. Police authorities are also directed to maintain peace and tranquility at the locale and to see that no untoward incident takes place. 9. Writ petition stands disposed of. 10.
