JUSTICE R.K. PATTANAIK Order No. ORDER 02.07.2026 01. 1. Heard learned counsel for the petitioner and the learned AGA for the State. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Kissannagar P.S. Case No.121 of 2026 corresponding to G.R. Case No.569 of 2026 pending in the file of learned J.M.F.C. (Cog-IV), Cuttack on the grounds stated therein. 3. Perused the FIRs as at Annexures-1 & 2. The alleged incident stands narrated in the FIR. For the self-same incident, a counter FIR is lodged from the side of the petitioner. It is claimed that though there is allegation of assault by means of Katuri and iron rod but the victim has not received any grievous injury. It is also claimed that co-accused, namely, Raja @ Pranab Kumar Mohanty has been granted bail by the learned Sessions Judge, Cuttack vide order dated 6th May, 2026. A p. 2 copy of the said order is produced at the time of hearing. From the above order, it is revealed that the injury report was submitted to the learned Sessions Court and the injuries received by the victim found to be simple in nature. Considering the above facts and the involvement of the petitioner, who is similarly situated like the above named accused, who is on bail, this Court is of the view that it is not a fit case for bail, however, is inclined to direct the petitioner to surrender before the learned court below for being released with similar terms and conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL stands disposed of. It is directed that in the event, the petitioner surrenders before the learned J.M.F.C. (Cog.-IV), Cuttack in connection with Kissannagar P.S. Case No.121 of 2026 corresponding to G.R. Case No.569 of 2026 within a period of fifteen days from today, he shall be released on bail subject to him furnishing bail bond of Rs.50,000/- (Rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not commit any offence in future; he shall neither try to tamper with the prosecution evidence nor threaten the prosecution witnesses in any manner and he shall appear before the I.O. once in a fortnight preferably on Sunday in between 10 A.M to 12 Noon till submission of final form. It is further p. 3 directed that violation of any of the conditions shall entail cancellation of bail granted to the petitioner. 6. Issue urgent certified copy as per rules. (R.K.
