By this Writ Petition, the petitioner has prayed for the following reliefs:- 10.1 Issue, an appropriate writ, order, or direction quashing and setting aside the notice dated 29.05.2026 (Annexure P/1) issued by Respondent No. 3, and consequently quashing and setting aside all proceedings relating to the no-confidence motion initiated against the petitioner pursuant thereto, being illegal, arbitrary, and in violation of Rule 3(3) of the Chhattisgarh Panchayat (Gram Panchayat Ke Sarpanch Tatha Up-Sarpanch, Janapad Panchayat Tatha Zila AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.07.01 13:34:35 +0530 2 Panchayat Ke President Tatha Vice-President Ke Virudh Avishwas Prastav) Niyam, 1994. 10.2 Quash the communication/order dated 22.06.2026( ANNEXURE P/2)issued by Respondent No. 3 whereby the representation submitted by the petitioner and the villagers was rejected without proper consideration; 10.3 Pass any other order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in the interest of justice. 2. Learned counsel for the petitioner submits that the petitioner was duly elected Sarpanch of Gram Panchayat Kurenga, Janpad Panchayat, Tokapal, District Bastar Chhattisgarh. On 29.05.2026, Respondent No.3 issued an order stating that Panchs of Gram Panchayat Kurenga have moved a motion of no confidence against the Sarpanch- Petitioner, therefore, a meeting was directed to be scheduled on 04.06.2026. 3. At this stage, learned counsel for the petitioner submits that no confidence motion has already been passed against the petitioner, as such, he seeks permission of this Court to withdraw this petition with liberty to approach before the concerned Authority having jurisdiction, however, he submits that since process of recruitment of new Sarpanch is scheduled to be held today itself, as such, some interim protection may be granted till then. 4. Considering the submission made by the petitioner, this Writ Petition is disposed of as withdrawn while allowing learned counsel for the 3 petitioner to move before concerned Collector as provided under the law by filing appeal and interim application, within a period of seven days. 5. Till seven days, effect and operation of the memorandum dated 24.06.2026 passed by the Chief Executive Officer, Janpad Panchayat Tokapal is stayed and no coercive steps shall be taken against the petitioner. 6.
