We find from the records that Original Application was filed by the writ petitioners raising certain grievance regarding a recruitment process. O.A. No. 443 of 2025 was filed at a time when the Tribunal already was non- functional. Since the Tribunal was non-functional, the writ petitioners could not be left remedyless and had the option for filing the writ petition before the Hon’ble Single Judge Bench dealing with the determination. Instead of doing so the writ petitioners filed an Original Application before the non-functional Tribunal and having filed such application has filed a W.P.S.T which is placed before the Division Bench. 2. After some arguments, faced with the above circumstances, the learned advocate for the writ petitioners submits that the writ petitioners would be approaching the Hon’ble Single Judge Bench in respect of the relief for which the Original Application was filed. 2 3. To facilitate such course of action and to enable the writ petitioners to avail the remedy in accordance with law, we dispose of the writ petition as well as O.A. No. 443 of 2025 pending before the West Bengal Administrative Tribunal. 4. The writ petition is dismissed with liberty as recorded above. 5.
