The petitioners are apprehending their arrest in connection with Tandwa P.S. Case No.57 of 2022 for the alleged offences registered under Sections 147, 148, 149, 188, 342, 323, 324, 325, 307, 435, 436, 285, 353, 504 and 506 of Indian Penal Code, Section 27 of Arms Act and Section 3/4 of Prevention of Damage to Public Property Act pending in the Court of learned Judicial Magistrate 1st Class, Chatra. 3. Learned counsel appearing for the petitioners submits that the allegations are made that on 23.02.2022 the entire work of NTPC Tandwa has been completely blocked by about 129 named and about 500 to 700 unknown members of Bishthapith Vikash Sangharsha Samitee, Tandwa. It is also alleged that after forming 2026:JHHC:9458 --2-- A.B.A. No. 1194 of 2026 unlawful assembly by large number of people armed with Lathi, Danda, Tangi, Spade, Iron rod etc. jostled with the employees of NTPC and threatened to kill in which for controlling tear gas was used by the police. He further submits that in identical situation co- accused persons have already been granted anticipatory bail in ABA Nos.4439 of 2022 and 3060 of 2022. He also submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.16 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of entering into altercation. 5. Considering that allegations are there against 129 named and about 500 to 700 unknown members and in identical situation co-accused persons have already been granted anticipatory bail in the aforesaid ABAs and the petitioners have got no criminal antecedent as disclosed in paragraph No.16 of the petition and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
