Sharma, Additional Advocate General. ------------------------------------------------------------------------------------ Jyotsna Rewal Dua, Judge Petitioner seeks direction to the respondent- Department to consider her case for appointment as Junior Basic Trained (JBT) Teacher in District Kangra pursuant to notification dated 11.10.2023. 2. Heard and considered the case file. 3. Recruitment & Promotion Rules for the post of JBT Teacher were notified on 22.09.2017. In terms of the aforesaid Rules, passing of Teacher Eligibility Test (TET) JBT exam was a condition precedent so as to make the candidate eligible for the post of JBT Teacher. The 1 Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 advertisement, inviting applications for filling up the posts of JBT Teachers, was issued on 11.10.2023. Admittedly, the petitioner did not have required minimum essential educational qualification of passing TET JBT, at the time of publishing of advertisement by the respondent-Department. She qualified TET JBT exam on 10.11.2023. Therefore, respondents’ stand is justified that the petitioner was not eligible to be considered for the post in question under the advertisement, as she did not satisfy the minimum essential educational qualification criteria laid down in the advertisement. Consequently, the relief as claimed by the petitioner, cannot be granted to her. Accordingly, the writ petition is dismissed. Pending miscellaneous application(s), if any, also stand dismissed.
