Heard the learned counsels appearing on behalf of the parties.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.05.2026 in connection with Deori P.S. Case No. 43/2026, registered under Sections 65(1) and 351(3) of Bharatiya Nyaya Sanhita, 2023 and Sections 2/4 of the POCSO Act, now pending in the court of learned Additional District and Sessions Judge- VIII -cum-POCSO Special Court, Giridih.

Learned counsel for the petitioner further submits that there is a delay of 06 days in lodging the First Information Report. He submits that it is alleged by the victim, who is also the informant of the case, that the petitioner committed rape upon her under threat of knife. The
learned counsel submits that though the victim is minor, aged 15 years, but she wants to marry the petitioner.

Learned counsel for the petitioner has also submitted that charge sheet has been submitted on 10.06.2026.

Learned counsel for the opposite party - State has opposed the prayer for bail.

After hearing the learned counsels for the parties and considering the direct allegation made against the petitioner and the impugned order reveals that the victim aged 15 years has supported the prosecution case in her statement recorded under Section 183 of Bharatiya Nagarik Suraksha Sanhita, 2023, this Court is not inclined to enlarge the petitioner on bail and hence, this bail application is

rejected.
