The petitioner who is a member of Kalinagar 2 Gram Panchayat along with respondent nos. 11 to 19 moved a no confidence motion against the Pradhan of the Panchayat being the 7th respondent herein before the Prescribed Authority and Block Development Officer, Raninagar II Block, being the 4th respondent herein on 2nd March, 2026 which was received by the latter on the same date. No step has been taken by the 4th respondent in respect of the same till date. Upon consideration of the submission made on behalf of the parties, this Court is of the view that the 4th respondent ought to have taken steps in respect of the no confidence motion submitted on 2nd March, 2026 in terms of Section 12 of the West Bengal Panchayat Act, 1973. Since no step has been taken, the 4th respondent is directed to treat the date of communication of this order as the date of submission of the no confidence motion and deal with the same in terms of Section 12 of the Act. The time frame stipulated in the Act should be strictly adhered to. 2 A copy of this order be communicated to the 4th respondent by the petitioner at the earliest. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
