The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No. 35 of 2023, registered for the offence under Sections 414 and 34 of the Indian Penal Code and Sections 33, 41 and 42 of the Indian Forest Act, pending in the court of learned Judicial Magistrate, 1st Class, Dumka. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the allegation of carrying wooden logs, which were cut from the forest is not correct. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of carrying the wooden logs of the forest. On this ground, he submits that anticipatory bail may kindly be rejected. 5. In the seizure list, it has been stated that 30 pieces of wood logs have been recovered, which were loaded on the pick-up van and the petitioner was driving the said vehicle and further this act is having [ 2026:JHHC:24845] -2- the direct impact upon the environment. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, above named. Accordingly, his prayer for anticipatory bail is rejected.
