1. By this petition, petitioner herein is seeking direction upon respondent No. 6 to consider and decide the complaint of the petitioner filed under the Jammu & Kashmir Public Premises (Eviction of Unauthorized Occupants) Act, 1988 pertaining to Shop No. 77-A situated at Fruit & Vegetable Market Parimpora, Srinagar, which qualifies as public premises in terms of the Act of 1988 supra.
2. Vide order dated 21.07.2026, Mr. H. Aman Ali, learned Dy.AG was
directed to seek and report instructions. He has produced a copy of the communication dated 23.07.2026 issued by the Area Marketing Officer Horticulture (P&M) Srinagar to Deputy Director (K) Horticulture (P&M), Srinagar, wherein it is stated that the documents pertaining to the claim of the petitioner were received on 22.07.2026 and the same have been handed over to the concerned Tehsildar. Copy of the communication dated 23.07.2026 is taken on record.
3. Learned counsel for the respondents submits that the Tehsildar Shalteng has to take a decision on the complaint of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner would feel satisfied, in case the present petition is disposed of at this stage, with a direction to the respondents to consider and decide the complaint of the petitioner, within a reasonable period of time.
5. Mr. H. Aman Ali, learned Dy.AG is not averse to the preposition made by the learned counsel for the petitioner.
6. Be that as it may, the instant petition is disposed of at the threshold with a direction to respondent No. 6 to consider and decide the petitioner's complaint dated 25.04.2026 within a period of one month from the date of passing of this order, by passing a reasoned and speaking order. Respondent No. 6, Tehsildar, Shalteng, shall afford an opportunity of hearing to all concerned parties before taking a decision.
7. Disposed of on the above lines.
