JUSTICE E.S.INDIRESH ORAL ORDER 1. Heard the learned counsel appearing for the parties. 2. In this writ petition, the petitioner is assailing the show cause notice dated 05.06.2024 (Annexure- A), report dated 15.05.2024 (Annexure-C) and Survey Sketch (Annexure-D) passed by respondent Nos.4 and 3 respectively, inter alia sought for direction to the respondent - authorities not to form road in the land bearing Survey No.92/1 measuring 2 acres 20 guntas situated at Kallukote Village, Kasaba Hobli, Sira Taluk, Thumkur District. 3. Having taken note of the submissions made by the learned counsel for the petitioner, it is contented that the respondent - authorities were interfering with the land belonging to the petitioner and also considering the specific notice produced at Annexure-A, wherein it is shown that the petitioner has put a compound in the land belonging to the Government. - 4 - HC-KAR NC: 2026:KHC:30548 WP No. 21119 of 2024 4. In this regard, having heard the learned counsel appearing for the parties, I am of the view that a joint survey shall be made by respondent Nos.2 and 3 in the presence of the petitioner to ascertain the property in question and demarcate that belonging to the petitioner and also insofar as the public road which has been claimed by the respondents. Therefore, to facilitate for resolution of the dispute between the parties, respondent Nos.2 and 3 are directed to conduct the joint survey of the subject land on 15.07.2026 at 11.00 a.m., and on that particular day, the petitioner shall be present at the time of the joint survey that may be made by respondent Nos.2 and 3 in respect of the schedule property. 5. However, till the conclusion of the joint survey that may be conducted respondent - authorities are restrained from interfering with the schedule property belonging to the petitioner. - 5 - HC-KAR NC: 2026:KHC:30548 WP No. 21119 of 2024 6.
