The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.201/2025, registered at Police Station Nandini, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.06.30 14:44:56 +0530
2 District Durg (C.G.) for alleged commission of offence punishable under Sections 318(4), 338, 336(3), 340(2), 111(2), 61(2), 3(5) of BNS, 2023 and Section 66(C) of IT Act.

Case of the prosecution, in brief, is that a report has been lodged by complainant the concern Tahsildar Radheshyam Verma Tahsil Karyalay Ahivara on 13th August 2025 in police station Nandini that some unknown persons have changed bhuiya software of Tehsil Ahiwara and they had the ID of one Patwari and there after they have created forged Rin Pustika for above land and thus they have changed the area and other land record and on the basis of the above forged documents they have also applied for loan in SBI and when the loan was sanctioned in the name of present applicant, the fact and the above fraud came into knowledge of Tehsildar he reported the matter that the above forged persons have obtained loan facility from State Bank of India and they misappropriated the entire money and during investigation the police also found the present applicant is also involved in the above case. Hence, this anticipatory bail application.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is argued that there is no direct material or specific allegation of fraud against the applicant, and his implication is based only on the memorandum statements of co-accused persons. It is further submitted that the main allegation is against Sanjay Verma, while the alleged fraud was committed due to lapses on the part of the
3 bank officials after verification of the land records. The applicant has no criminal antecedents and is not involved in any other similar offence. It is also contended that similarly placed co- accused persons have already been granted anticipatory bail and regular bail by this Court, and therefore, on the ground of parity, the present applicant is also entitled to the same relief. He would submit that the applicant is a permanent resident of address shown in the cause title, there is no likelihood of his absconding or tampering with the prosecution evidence, and he undertakes to abide by all conditions imposed by this Court. Therefore, it is prayed that the applicant be granted anticipatory bail.
4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. He would submit that anticipatory bail application of the main accused Sanjay Kumar Verma has been rejected by this court in MCRCA No. 1946 of 2025 on 11.12.2025.
5. I have heard learned counsel for the parties and perused the materials available on record.
6. Considering the facts & circumstances of the case, submission of
learned counsel for the parties, materials available on record, allegation against the applicant is that he, in conspiracy with the co-accused, used forged land records and a forged Rin Pustika prepared by manipulating the Bhuiya software to obtain a loan from the State Bank of India in his name, and thereafter misappropriated the loan amount, thereby committing fraud and
4 forgery, further considering the fact that anticipatory bail application of the main accused Sanjay Kumar Verma has been rejected by this court in MCRCA No.1946 of 2025 on 11.12.2025, considering the serious nature of the allegations and also considering the fact that investigation is still going on, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant - Dinuram Yadav, involved in Crime No.201/2025, registered at Police Station Nandini, District Durg (C.G.) for alleged commission of offence punishable under Sections 318(4), 338, 336(3), 340(2), 111(2), 61(2), 3(5) of BNS, 2023 and Section 66(C) of IT Act is rejected.
