The petitioner is apprehending his arrest in connection with Basantrai P.S. Case No.18 of 2026, for offence registered under section 64(2)(m), 78, 351(3), 108, 62, 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate, First Class, Godda.

Learned counsel for petitioner submits that the petitioner has earlier moved before this Court in ABA No.2793 of 2026 which was withdrawn by the petitioner and he further submits that process under section 84 BNSS, 2023 has been issued. He next submits that thereafter the petitioner has challenged the process

under section 84 BNSS, 2023 before this court in Cr.MP No.1662 of 2026 which was allowed by the order dated 23.07.2026 and thereafter the present anticipatory application has been filed. He next submits that under the misconception the case was lodged and now a good sense has prevailed between the petitioner and the informant and they have compromised the matter. He next submits that the compromise has been filed in the form of I.A. No.11113 of
2026.
4. Learned State counsel submits that in light of the said I.A., it appears that compromise is there. He further submits that however the alleged sections are not compoundable.

Learned counsel for the informant accepts the submission of the learned counsel for the petitioner and submits that compromise is there and under the misconception the case has been lodged.

In view of the statement made in the said I.A., it transpires that both the parties have compromised the matter and earlier the anticipatory bail application was dismissed as withdrawn as the process under section 84 BNSS, 2023 was already issued which has been later on quashed by this Court in the aforesaid Cr.M.P. and in this background, the instant petition has been filed. The instant I.A filed by the petitioner in this petition which has also been accepted by the informant and under the changed circumstances this petition can be entertained and in the attending facts and circumstances of

the present case, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Godda, in connection with Basantrai P.S. Case No.18 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
