This appeal is directed against the order dated 24.07.2026 passed in M.C.A. No. 1154/2026, arising out of Deori P.S. Case No. 95 of 2024, by the learned Additional Sessions Judge-I-cum-Special Judge SC/ST (POA) Act, Giridih, whereby and whereunder, the prayer for bail of the appellant has been rejected. It appears that the appellant had earlier moved for grant of bail in Cr. Appeal (DB) No. 555/2026 which however was dismissed as withdrawn vide order dated 09.06.2026. It has been submitted by the learned counsel for the appellant that after the withdrawal of the criminal appeal filed earlier several of the witnesses have been examined by the prosecution including the victims and six of the victims have been declared hostile by the court. Learned counsel for the appellant has also submitted that the informant has been examined as P.W.7 and he has not identified the appellant as the person who was involved in trafficking of children. Learned counsel adds that the appellant is in custody since 25.02.2026. Learned P.P. has opposed the prayer for bail of the appellant. It appears that the victims who have been examined have been declared hostile by the court and the same was after the withdrawal of the earlier prayer for bail of the appellant vide order dated 09.06.2026. Regard being had to the changed circumstance as noted above and there being a dearth of evidence to indicate about the involvement of the appellant in trafficking of children, we while setting aside the order dated 24.07.2026 passed in M.C.A. No. 1154/2026, arising out of Deori P.S. Case No. 95 of 2024, by the learned Additional Sessions Judge-I-cum-Special Judge SC/ST (POA) Act, Giridih, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I- cum-Special Judge SC/ST (POA) Act, Giridih in S.T. Case No. 242/2026, arising out of Deori P.S. Case No. 95 of 2024, subject to the condition that the appellant shall remain physically present before the learned trial court on each and every date till the conclusion of the trial, unless prevented by sufficient cause.
