The present petition has been filed by the petitioners seeking the following relief(s): “(a) Call for the records of Criminal Case No. 1899/2024 pending before the learned JMFC, Durg; (b) Quash the FIR no.0002 dated 04/01/2024 under section 498A IPC and 34 IPC registered at Police Station Mahila Thana, Durg against the petitioner and also quash the charge sheet dated 20/02/2024 filed in the consequence of the impugned FIR i.c. ANNEXURE P-1 (c) Quash the entire proceedings in Criminal Case No. 1899/2024; That this Hon'ble Court be further pleased to quash the impugned order dated 08/04/2024 Passed by the Learned JMFC, Durg and also the entire proceedings of the Criminal Case bearing Case No.RCC/1899/2024 "State of Chhattisgarh vs. aday gaibhiya and Others" pending before the Learned Judicial Magistrate First Class, Durg i.e. ANNEXURE P-2. From perusal of the record, it appears that the present petition has been filed seeking quashment of the criminal proceedings on the basis of a compromise alleged to have been entered into between the parties. It has been stated in the petition that the complainant, in her deposition dated 20.01.2025, has turned hostile, denied all the allegations of cruelty and dowry harassment, and expressed her willingness to 3 compromise the matter. However, no compromise deed or any other documents has been filed along with the present petition. The factum of compromise has merely been averred in the petition and is not supported by any document placed on record. Further, despite repeated calls, none appears on behalf of the petitioners to prosecute the matter. 4. In view of the aforesaid and also that no representation is made on behalf of the petitioner on repeated calls, the present petition is dismissed for want of prosecution.
