03/ 21.08.2026: This bail application has been filed by the petitioner under Sections 483 and 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 317(5), 3(5) of BNS and under Sections 21(b) & 22(b) of the NDPS Act.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. Learned Spl. P.P. opposes the prayer for bail.
4. The prayer for bail of the petitioner was earlier rejected.
5. The FSL (Forensic Science Laboratory) report has been produced in sealed cover. A copy of the same be kept on record. The original report be sealed again and handed over to the State.
6. It appears from the FSL (Forensic Science Laboratory) report that material recovered is heroin, which is a highly addictive narcotic intoxicant.
7. Considering the FSL report, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Katkamsandi P.S. Case No.196 of 2025, corresponding to N.D.P.S. Case No.65 of 2026, pending in the Court of
learned Principal District & Sessions Judge-Cum-Special Judge, N.D.P.S. Act, Hazaribag, stands rejected.
8. Accordingly, this bail application is dismissed.
9. It is expected that the Trial will be concluded at the earliest.
