1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. He is not the principal accused.
2. Learned counsel for the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the FIR, the statements of eye-witnesses and the injury reports, which show serious injury inflicted on a vital part of the body like head. The CT Scan of brain shows that there were hemorrahagic contution in the right temporal, tentorial leaf bleed and mild cerebral edema.
3. It is the prosecution case that although the accused first hit the petitioner with an iron rod, thereafter the present petitioner and others came in and started assaulting the victim.

4. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.
5. Accordingly, the application for anticipatory bail is rejected.
