Having taken note of the submissions made by the learned counsel for the parties, the claim made by the petitioner herein is to transfer of Khata of the land bearing - 3 - HC-KAR NC: 2026:KHC:30557 WP No. 16596 of 2026 Survey Nos.57/2 and 57/3 of Kibbetta Village, Somavarpete Taluk, Kodagu District. 3. Taking into consideration that already the Phodi has been affected in respect of the subject land, I am of the view that, it is open for the petitioner to challenge such Phodi which has been already made, which is against the petitioner and therefore, reserving liberty to the petitioner as such, the petition is disposed of.
