JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the registration of a crime in Crime No.18/2026 punishable for the offences under Sections 168, 169, 420, 504, 506 read with Section 34 of the Indian Penal Code. 2. Heard Sri. R.P.Somashekharaiah R.P., learned counsel appearing for the petitioners, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.Chikkahanumaiah T.C., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compromise petition which reads as follows: “The petitioners and Respondent No.2 herein humbly submits as follows: 1. That, the petitioners herein being aggrieved by the registering of the FIR in Crime No.18/2026, for the offences under Section 168, 169, 420, 504, 506 R/W Section 34 of IPC, on the file of the II Addl. Civil Judge - 4 - HC-KAR NC: 2026:KHC:17958 CRL.P No. 3073 of 2026 and JMFC, Nelamangala, is approached this Hon'ble High Court in this Criminal petition. 2. That it is submitted that the Petitioner No.1 entered into agreement of sale dtd.21/3/2024 with the Respondent No.2 in respect of property bearing Sy. No.109/3A, measuring 11 guntas, situated at Machanahalli Village, Somapura Hobli, Nelamangala Taluk, Bengaluru Rural District, and similarly the Petitioner No.2 entered into agreement of sale dtd.21/3/2024 with Respondent No.2 in respect of property bearing Sy. No.109/11, measuring 9 guntas, situated at Machanahalli Village, Somapura Hobli, Nelamangala Taluk, Bengaluru Rural District. 3. That the petitioners submits that, since, the petitioner No.1 and 2 because of differences with respondent No.2, decided to cancel the agreement of sale, and accordingly cancelled the agreement of sale, on 16/12/2025 and on 2/12/2025. 4. That the petitioners submits that, though the matter was settled between the petitioners and respondent No.2, but respondent No.2 has lodged complaint to the Dy. S.P. Nelamangala Sub-Division, Nelamangala on 2/11/2025, and thereafter the same was closed after recording the statement of the petitioners and Respondent No.2, in front of the petitioners. 5. That despite even though respondent No.2 not willing to continue the complaint, based on the complaint which was already closed, after the recording the statement, once again, registered the case against the petitioners, with an ill will motive in Cr. No.18/2026 on 30/1/2026, for the offence under Section 168, 169, 420, 504, 506 and R/W Section 34 of IPC. 6. It is submitted that the offences registered against the petitioners are compoundable and as such the petitioners prays this Hon'ble Court to compound the offences by recording the settlement arrived between the parties. 7. That as stated above, the petitioners and respondent No.2 have settled the dispute amicably at the intervention of the wellwishers and family members. Hence, both the parties decided to end the dispute - 5 - HC-KAR NC: 2026:KHC:17958 CRL.P No. 3073 of 2026 amongst themselves and as such the respondent No.2 has no objection to allow the petition and to quash the proceedings in Cr. No.18/2026 for the offence under Section 168, 169, 420, 504, 506 and R/W Section 34 of IPC. WHEREFORE, for the reasons stated above it is most respectfully prayed that this Hon'ble Court may be pleased to quash the FIR in Crime No.18/2026, for the offences under Section 168, 169, 420, 504, 506 R/W Section 34 of IPC, on the file of the II Addl. Civil Judge and JMFC, Nelamangala, in the ends of justice and equity." 4. The parties to the lis are before this Court and are identified by their respective counsels. 5. In the light of compromise petition being filed and offences not being against the State, I deem it appropriate to accept the compromise petition and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [i] Criminal Petition is disposed. [ii] FIR in Crime No.18/2026 registered by Nelamangala Town P.S., for the offences punishable under Sections 168, 169, 420, 504, 506 read with - 6 - HC-KAR NC: 2026:KHC:17958 CRL.P No. 3073 of 2026 Section 34 of the Indian Penal Code, pending before the II Addl.
