1. Heard Mr. A. Ahmed, learned counsel for the petitioner. Also heard Ms. S. H. Bora, learned Additional Public Prosecutor for the State of Assam.
2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 challenging the Order dated 03.08.2024, passed by the learned Assistant Sessions Judge No.1, Kamrup (Mtero) at Guwahati in Sessions Case

3. The petitioner has been facing trial before the Court below. He was allowed to go on bail by that Court. On 03.08.2024, he was absent without steps; however, on that day, the Presiding Officer of the Court was also on leave but, the order dated 03.08.2024 shows that NBWA was directed to be issued against him.
4. I have considered the submissions made by learned counsel for both sides.
5. The petitioner has shown sufficient reasons for his absence before the Trial Court on that day. Therefore, the prayer of the petitioner is allowed.
6. The NBWA issued against the petitioner shall be recalled.
7. The petitioner, Manjeet Das is directed to appear before the Trial Court of the learned Additional Sessions Judge No.2, Kamrup (Metro) at Guwahati within next 7 (seven) days from today.
8. He shall be allowed to remain on previous bail.
9. With the aforesaid direction, the Criminal Petition stands disposed of.
