ORAL ORDER (PER: HON'BLE MR. JUSTICE M.NAGAPRASANNA)
The petitioner is before this Court seeking the following prayer:
“(i) Issue writ in the nature of Mandamus or any other appropriate writ, order or direction and thereby direct the Respondents to consider the representation dated 06-03-2024 as per ANNEXURE – A respectively and thereby regularize the vacant house site as described in the schedule in favour of the Petitioner as alternate site, and
(ii) To grant such other and further relief so as to cost of the proceedings as this Hon’ble Court deems fit in the circumstances of the case in the interest of justice and equity.”

3. The petitioner claims that the purchased portion on the north side of house No.13 is vacant and the residential layout is fully developed. Therefore, the petitioner's vacant site has to be regularised is the claim of the petitioner. Towards the said claim, a representation is submitted by the petitioner to respondent Nos.2 and 3 – Bengaluru Development Authority, which has not yet met its consideration and therefore, the petitioner is at the doors of this Court.
4. In the light of the identical orders passed by this Court directing consideration of the representation of the petitioners therein, particularly, for the purpose of regularization of the sites, we deem it appropriate to direct respondent Nos.2 and 3 – Bengaluru Development Authority to consider the representation of the petitioner dated 06.03.2024 for the purpose for which it is rendered, within 12 weeks from the date of receipt of the copy of the order, if not earlier and also communicate the said order that would be passed by respondent Nos.2 and 3 to the petitioner.

5. With the aforesaid direction, the writ petition stands allowed. Ordered accordingly.
