This is the second bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 33/2025 registered at Police Station Singhoda, District – Mahasamund (C.G.), for the offence punishable under Section 20(b) of Narcotic Drugs and Psychotropic Substances Act. 2. The earlier bail application of the applicant being MCRC No. 9384 of 2025 was rejected by this Court vide order dated 20.11.2025 on merits. 3. The case of the prosecution, in brief, is that on 06.04.2025, at about 10:50 A.M., the patrolling police received secret information from an informer that a grey-coloured Creta car bearing Registration No. MH-16- BY-1011, in which two persons were carrying ganja, was travelling from ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.06.30 11:04:39 +0530 2 Odisha towards Chhattisgarh. Acting upon the said information, the police intercepted the said vehicle and conducted a search, during which 60 kilograms of ganja, kept in three sacks containing 20 kilograms each and valued at Rs. 9,00,000/-, was allegedly recovered and seized from the vehicle. At the relevant time, the present applicant, Suyash Bhaurao Gore, and co-accused, Saurav Sahebram Indapure, were travelling in the said vehicle and were allegedly found in possession of the contraband article. Accordingly, the offence was registered, and they were arrested. 4. Learned counsel for the applicant submits that this is the second bail application of the applicant. The first bail application was rejected by this Hon’ble Court vide order dated 20.11.2025. He submits that 04 prosecution witnesses have been examined by the prosecution. PW-01, Rohit Sidar, is a Constable, and several infirmities have emerged in his cross-examination. PW-02, Bhupendra Sahu, is a seizure witness, and he has turned hostile. PW-03, Gushamani Pradhan, is also a seizure witness, and he has turned hostile. PW-04, Ganesh Ram, is the weighing witness, and he has also turned hostile. It is further submitted that the applicant has been in judicial custody since 06.04.2025 and the conclusion of the trial is likely to take considerable time. On these grounds, prayer is made for grant of regular bail to the applicant. 5. On the other hand, learned State counsel opposes the bail application of the present applicant. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. From perusal of the pleadings, it appears that no new ground has been raised in this second bail application, except that, as of today, only 04 out of the 16 prosecution witnesses have been examined, and out of them, 03 prosecution witnesses have turned hostile and the same does not 3 constitute a sufficient ground for granting bail. Accordingly, I do not find any justification for granting bail, and the present second bail application filed by the applicant is rejected at this stage. 8. Accordingly, the second bail application of the applicant – Suyash Bhaurao Gore, filed under Section 483 of the BNSS involved in Crime No. 33/2025 registered at Police Station Singhoda, District – Mahasamund (C.G.), for the offence punishable under Section 20(b) of Narcotic Drugs and Psychotropic Substances Act, is rejected. 9. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial as expeditiously as possible within a period of six months from the receipt of a certified copy of this order in accordance with law, if there is no legal impediment. 10.
