Petitioner has filed this petition under Article 226 of the Constitution of India with following reliefs: “RELIEF SOUGHT: A. That, the Hon'ble court may kindly be pleased to call for the entire records pertaining to the case of the petitioner for kind perusal of this Hon'ble court. B. That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions to direct the Respondent No. 1-5 to restore the electricity connections of the Petitioner immediately in his Electric Meter bearing B P No. 1008802733 and not to disconnect the same till the genuineness of the due electricity bill is arrived by considering the materials available with both the parties. C. That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions to the respondent authorities especially Respondent No. 6 to accept the Grievance Letter and decide the said Representation of the petitioner within a stipulated period of time and/or Direct the Permanent Lok Adalat (Public Utility Service) to decide the Case No. 1838/2025 within stipulated period of time. D. That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/order, direction/directions to pay the compensation 3 amount of Rs. 5,00,000/- to the petitioner for the wrongful act committed by Respondent No. 1-5. E. Any other relief which may be deemed fit by this Hon'ble court just and proper in the facts and circumstances of the case may also be provided in favor of the petitioner.” 2. Learned counsel appearing for the petitioner submitted that present writ petition challenges the legality, validity and propriety of the action of the respondent -authorities in disconnecting the electricity supply/connection from Meter bearing BP No.1008802733 installed at the premises of Vardan Hotel belonging to the petitioner. Aggrieved by the said action, the petitioner has approached this Court seeking the aforesaid reliefs. 3. Learned counsel appearing on behalf of the State as well as learned counsel for CSPDCL opposed the reliefs sought by the petitioner. 4. Heard learned counsel for the parties and perused the pleadings and documents available on record. 5. Considering facts of the case, nature of the reliefs and submissions advanced by learned counsel for the respective parties, present writ petition is disposed of with a direction to the concerned electricity department to restore the electricity supply/connection of Meter installed at hotel premises of the petitioner within a period of three (03) days from today, subject to the petitioner depositing 50% of the fine amount as directed by the electricity department. 4 Out of the said amount: (i) 25% amount shall be deposited within fifteen (15) days from today. (ii) the remaining 25% shall be deposited within a period of two (02) months from the date of the first deposit. 6. It is made clear that in the event of non-compliance with the directions contained herein, the electricity department will be at liberty to pass an appropriate orders and take appropriate action in accordance with law. 7. It is made clear that this Court has not passed any order on merits as the matter is pending for considering on merits before the 8th Special Judge (Electricity Act), Raipur, (CG) under Section 135 of the Electricity Act, 2003 bearing Complaint Case No.18/2025. Any order passed by the said Court would be binding upon the parties. The amount deposited by the petitioner would be adjusted in the final order/judgment passed in the aforesaid complaint case.
