JUSTICE E.S.INDIRESH ORAL ORDER In this Writ Petition, the petitioner has sought for declaration that the provisions under Regulation 8.3(b) of the National Medical Commission (Postgraduate Medical Education) Regulations, 2023 must be computed in accordance with the accepted mathematical formula for percentage difference between two numbers, and not by - 3 - HC-KAR NC: 2026:KHC:17920 WP No. 7606 of 2026 adopting an arbitrary calculation based on 15% of the maximum marks. 2. Learned counsel appearing for the petitioner submitted that, the petitioner be directed to approach the respondent No.1 - University for raising the grounds urged in the present writ petition concerned. 3. At this juncture, Sri. H.R. Showri, learned counsel appearing for respondent No.2 places reliance on the Order of Division Bench of this Court in Writ Appeal No.2050/2025 and connected matters disposed of on 05.03.2026 and submitted that the dispute raised by the petitioner herein has been already concluded by the Division Bench of this Court. 4. Smt. Mamata G. Kulkarni, learned counsel appearing for the respondent No.1 - University supports the contention of the learned counsel appearing for respondent No.2. - 4 - HC-KAR NC: 2026:KHC:17920 WP No. 7606 of 2026 5. In that view of the matter, taking into consideration the arguments advanced by the learned counsel at Bar, I am of the opinion that, liberty be reserved to the petitioner to approach respondent No.1 - University for redressal of his grievance. It is also made clear that since the respondent No.1 - University has filed the aforementioned Writ Appeal No.2050/2025 and connected matters, it is open for the respondent No.1 - University to take a decision in the matter in accordance with the decision of this Court in the aforementioned Writ Appeals. 6.
