2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner Raju Kul Sheikh has prayed for releasing him on bail after he was arrested in connection with Kokrajhar P.S. Case No.07/2026 under Sections 109(2)/118(2)/132 and 262 of the BNS, 2023.
3. Earlier, the petitioner was arrested in connection with Kokrajhar P.S. Case No.06/2026 under Sections 64(2)(k) and 126(2) of the BNS.
4. On 11.01.2026 at about 5.43 P.M., a police party led by Sub-Inspector was taking the petitioner to the office of the Chief Judicial Magistrate, Kokrajhar. On the way, the petitioner wanted to attend the call of the nature. The police party stopped the vehicle and took him to the nearby jungle. After entering into the jungle, though handcuffed at that time, the petitioner attacked a police constable and snatched away the rifle. Ultimately, the police party had to fire two rounds from the service pistol of the said Sub-Inspector. In this way, the present case was registered on the basis of the FIR lodged by the said Sub-Inspector.
5. I have considered the submissions made by the learned counsel of both sides.
6. On a plain reading of the FIR, this Court is of the opinion that the petitioner does not deserve to be released on bail in this case. Accordingly, the bail application is dismissed and disposed of.
