The petitioner is apprehending his arrest in connection with Bokaro Thermal P.S. Case No.27 of 2025, registered for the offence under Sections 303(2), 317(5) and 3(5) of Bhartiya Nyaya Sanhita, 2023, Sections 4 and 21 of M.M.D.R. Act, 1957 and Sections 7 and 13 of Jharkhand Minerals (Prohibition of Illegal Mining, Storage and Transportation), Rules, 2017, pending in the court of learned Judicial Magistrate, 1st Class, Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the stored coal about 18 tonnes. She submits that only on suspicion, the petitioner has been implicated in the case and the said coal was not stored by the petitioner. She next submits that the land is not belonging to the petitioner where the alleged coal was stored. She further submits that the coal was recovered nearby the Konar River. 4. Learned counsel appearing for the State opposes the prayer and submits that the name of the petitioner has come on suspicion. 5. Considering that the name of the petitioner has come on suspicion and even coal has been recovered nearby the Konar River, I am inclined to grant anticipatory bail to the petitioner. 2026:JHHC:24966 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bermo at Tenughat, in connection with Bokaro Thermal P.S.
